This means that we are responsible for deciding how we hold and use personal information about You. We are required under data protection legislation to notify You of the information contained in this privacy notice.<\/p>\n<p>This notice applies to employees, children and parents. This notice does not form part of any contract of employment or other contract to provide services. We may update this notice at any time but if we do so, we will provide You with an updated copy of this notice as soon as reasonably practical.<\/p>\n<p>It is important that Employees, Children and Parents read and retain this notice, together with any other privacy notice we may provide on specific occasions when we are collecting or processing personal information about You, so that You are aware of how and why we are using such information and what Your rights are under the data protection legislation.<\/p>\n<p><strong>DATA PROTECTION PRINCIPLES<\/strong><\/p>\n<p>We will comply with data protection law. It does not include data where the identity has been removed (anonymous data).<\/p>\n<p>There are \u201cspecial categories\u201d of more sensitive personal data which require a higher level of protection, such as information about a person\u2019s health or sexual orientation.<\/p>\n<p><strong>Employees:<\/strong><\/p>\n<p>We will collect, store, and use the following categories of personal information about employees:<\/p>\n<ul>\n<li>Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses<\/li>\n<li>Date of birth<\/li>\n<li>Gender<\/li>\n<li>Marital status and dependents<\/li>\n<li>Next of kin and emergency contact information<\/li>\n<li>National Insurance number<\/li>\n<li>Bank account details, payroll records and tax status information<\/li>\n<li>Salary, annual leave, pension and benefits information.<\/li>\n<li>Start date and, if different, the date of an Employee\u2019s continuous employment.<\/li>\n<li>Location of employment or workplace.<\/li>\n<li>Copy of driving licence (where applicable).<\/li>\n<li>Recruitment information (including copies of right to work documentation, references and other information included in a CV or cover letter or as part of the application process).<\/li>\n<li>Employment records (including job titles, work history, working hours, holidays, training records and professional memberships).<\/li>\n<li>Personnel files and training records including performance information, disciplinary and grievance information, and working time records.<\/li>\n<li>Information about your use of our information and communications systems.<\/li>\n<li>Records of any reportable death, injury, disease or dangerous occurrence.<\/li>\n<\/ul>\n<p>We may also collect, store and use the following \u201cspecial categories\u201d of more sensitive personal information:<\/p>\n<ul>\n<li>Information about an employees race or ethnicity<\/li>\n<li>Information about an employee\u2019s health, including any medical condition, accident, health and sickness records, including:\n<ul>\n<li>Where an employee leaves employment and under any share plan operated by a group company the reason for leaving is determined to be ill-health, injury or disability, the records relating to that decision;<\/li>\n<li>Details of any absences (other than holidays) from work including time on statutory parental leave and sick leave; and<\/li>\n<li>Where an employee leaves employment and the reason for leaving is related to their health, information about that condition needed for pensions and permanent health insurance purposes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Children:<\/strong><\/p>\n<p>We will collect, store, and use the following categories of personal information about children:<\/p>\n<ul>\n<li>Name<\/li>\n<li>Date of birth<\/li>\n<li>Home address<\/li>\n<li>Dietary requirements<\/li>\n<li>Attendance information<\/li>\n<li>Photographs and video clips of the Child to signpost Children to where their belongings are stored at the nursery that they attend, and also for general display purposes<\/li>\n<li>Emergency contact should parents be unavailable and the emergency contact\u2019s contact details<\/li>\n<li>Record book for each child containing the work of the child whilst at the nursery, observations about the child\u2019s development whilst at the nursery from Employees of the nursery, specific examples of the child\u2019s progress, photographs demonstrating the child\u2019s development whilst at the nursery, and personal details of the child (e.g. their date of birth) (\u201cprogress report\u201d)<\/li>\n<li>Records relating to individual children e.g. care plans, common assessment frameworks, speech and language referral forms<\/li>\n<li>Accidents and pre-existing injuries forms<\/li>\n<li>Records of any reportable death, injury, disease or dangerous occurrence<\/li>\n<li>Observation, planning and assessment records of Children<\/li>\n<\/ul>\n<p>We may also collect, store and use the following \u201cspecial categories\u201d of more sensitive personal information:<\/p>\n<ul>\n<li>Information about a child\u2019s race or ethnicity, spoken language and nationality<\/li>\n<li>Information about a child\u2019s health, including any medical condition, health and sickness records.<\/li>\n<li>Information about a child\u2019s accident or incident reports including reports of pre-existing injuries.<\/li>\n<li>Information about a child\u2019s incident forms \/ child protection referral forms \/ child protection case details and reports.<\/li>\n<\/ul>\n<p><strong>Parents:<\/strong><\/p>\n<p>We will collect, store, and use the following categories of personal information about Parents:<\/p>\n<ul>\n<li>Name<\/li>\n<li>Home address<\/li>\n<li>Telephone numbers, and personal email addresses.<\/li>\n<li>National Insurance number.<\/li>\n<li>Bank account details.<\/li>\n<\/ul>\n<p>We may also collect, store and use the following \u201cspecial categories\u201d of more sensitive personal information:<\/p>\n<ul>\n<li>Information about a parent\u2019s race or ethnicity, spoken language and nationality.<\/li>\n<li>Conversations with parents where employees of the nursery deem it relevant to the prevention of radicalisation or other aspects of the governments Prevent strategy.<\/li>\n<\/ul>\n<p><strong>HOW IS YOUR PERSONAL INFORMATION COLLECTED?<\/strong><\/p>\n<p><strong>Employees:<\/strong><\/p>\n<p>We collect personal information about employees through the application and recruitment process, either directly from candidates or sometimes from an employment agency or background check provider. We may sometimes collect additional information from third parties including former employers, credit reference agencies or other background check agencies.<\/p>\n<p>We will collect additional personal information in the course of job-related activities throughout the period of when an Employee works for us.<\/p>\n<p><strong>Children and parents: <\/strong><\/p>\n<p>We collect personal information about children and parents from when the initial enquiry is made by the parents, through the enrolment process and until the children stop using the nursery\u2019s services.<\/p>\n<p><strong>HOW WE WILL USE INFORMATION ABOUT YOU<\/strong><\/p>\n<p>We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:<\/p>\n<ol>\n<li>Where we need to perform the contract we have entered into with you<\/li>\n<li>Where we need to comply with a legal obligation<\/li>\n<li>Where it is necessary for our legitimate interests (or those of a third party) and Your interests and fundamental rights do not override those interests<\/li>\n<\/ol>\n<p>We may also use your personal information in the following situations, which are likely to be rare:<\/p>\n<ul>\n<li>Where we need to protect your interests (or someone else\u2019s interests).<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Situations in which we will use employee personal information<\/strong><\/p>\n<p>We need all the categories of information in the list above (see employee section within the <a href=\"#co_anchor_a486023_1\">paragraph<\/a> entitled \u2018The kind of information we hold about you\u2019) primarily to allow us to perform our contracts with employees and to enable us to comply with legal obligations. The situations in which we will process employee personal information are listed below.<\/p>\n<ul>\n<li>Making a decision about an employee\u2019s recruitment or appointment<\/li>\n<li>Checking an employee is legally entitled to work in the UK. Paying an employee and, if an employee is an employee or deemed employee for tax purposes, deducting tax and National Insurance contributions (NICs)<\/li>\n<li>Providing any employee benefits to employees<\/li>\n<li>Enrolling you in a pension arrangement in accordance with our statutory automatic enrolment duties<\/li>\n<li>Liaising with the trustees or managers of a pension arrangement operated by a group company, your pension provider and any other provider of employee benefits<\/li>\n<li>Administering the contract we have entered into with an employee<\/li>\n<li>Conducting performance and\/or salary reviews, managing performance and determining performance requirements<\/li>\n<li>Assessing qualifications for a particular job or task, including decisions about promotions<\/li>\n<li>Gathering evidence for possible grievance or disciplinary hearings<\/li>\n<li>Making decisions about an employee\u2019s continued employment, engagement<\/li>\n<li>Making arrangements for the termination of our working relationship<\/li>\n<li>Education, training and development requirements<\/li>\n<li>Dealing with legal disputes involving employees, including accidents at work<\/li>\n<li>Ascertaining an employee\u2019s fitness to work<\/li>\n<li>Managing sickness absence<\/li>\n<li>Complying with health and safety obligations<\/li>\n<li>To prevent fraud<\/li>\n<li>To monitor your use of our information and communication systems to ensure compliance with our IT policies<\/li>\n<li>To ensure network and information security, including preventing unauthorised access to our computer and electronic communications systems and preventing malicious software distribution<\/li>\n<li>Equal opportunities monitoring.<\/li>\n<\/ul>\n<p>Some of the above grounds for processing will overlap and there may be several grounds which justify our use of an employee\u2019s personal information.<\/p>\n<p><strong>Situations in which the nursery will use personal information of children<\/strong><\/p>\n<p>We need all the categories of information in the list above (see children section within the paragraph entitled \u2018The kind of information we hold about you\u2019) primarily to allow us to perform our obligations (including our legal obligations to children. The situations in which we will process personal information of children are listed below.<\/p>\n<ul>\n<li>Upon consent from the parents, personal data of children will be shared with schools for progression into the next stage of their education.<\/li>\n<li>Personal information of children will be shared with local authorities without the consent of parents where there is a situation where child protection is necessary.<\/li>\n<li>The personal information of children will be shared with local authorities without the consent of parents for funding purposes.<\/li>\n<li>Ofsted\/ Care Inspectorate Wales\/ Estyn will be allowed access to the nursery\u2019s systems to review child protection records.<\/li>\n<li>To ensure we meet the needs of the children<\/li>\n<li>To enable the appropriate funding to be received<\/li>\n<li>Report on a child\u2019s progress whilst with the nursery<\/li>\n<li>To check safeguarding records<\/li>\n<li>To check complaint records<\/li>\n<li>To check attendance patterns are recorded<\/li>\n<li>When a child\u2019s progress report is given to its parent in order for that parent to pass the same Progress Report to a school for application or enrolment purposes<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Situations in which the nursery will use personal information of parents<\/strong><\/p>\n<p>We need all the categories of information in the list above (see parents section within the paragraph entitled \u2018The kind of information we hold about you\u2019) primarily to allow us to perform our contracts with parents and to enable us to comply with legal obligations. The situations in which we will process personal information of parents are listed below.<\/p>\n<ul>\n<li>The personal information of parents will be shared with local authorities without the consent of parents for funding purposes.<\/li>\n<li>To report on a child\u2019s attendance<\/li>\n<li>To be able to contact a parent or a child\u2019s emergency contact about their child<\/li>\n<li>To ensure nursery fees are paid<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>If employees and parents fail to provide personal information<\/strong><\/p>\n<p>If employees and parents fail to provide certain information when requested, we may not be able to perform the respective contracts we have entered into with employees and parents, or we may be prevented from complying with our respective legal obligations to employees, children and parents.<\/p>\n<p><strong>Change of purpose<\/strong><\/p>\n<p>We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify the employee, child or parent, as is appropriate in the circumstances, and we will explain the legal basis which allows us to do so.<\/p>\n<p>Please note that we may process an employee\u2019s, a child\u2019s or a parent\u2019s personal information without their respective knowledge or consent, as relevant to the circumstances, in compliance with the above rules, where this is required or permitted by law.<\/p>\n<p><strong>HOW WE USE PARTICULARLY SENSITIVE PERSONAL INFORMATION<\/strong><\/p>\n<p>\u201cSpecial categories\u201d of particularly sensitive personal information require higher levels of protection. We need to have further justification for collecting, storing and using this type of personal information. We have in place an appropriate policy document and safeguards which we are required by law to maintain when processing such data. We may process special categories of personal information in the following circumstances:<\/p>\n<ol>\n<li>In limited circumstances, with employee or parent explicit written consent<\/li>\n<li>Where we need to carry out our legal obligations or exercise rights in connection with employee employment.<\/li>\n<li>Where it is needed in the public interest, such as for equal opportunities monitoring or in relation to our occupational pension scheme.<\/li>\n<\/ol>\n<p>Less commonly, we may process this type of information where it is needed in relation to legal claims or where it is needed to protect an employee, a child or a parents\u2019 interests (or someone else\u2019s interests) and the employee, child or parent as is appropriate is not capable of giving consent, or where the employee or parent has already made the information public.<\/p>\n<p><strong>\u00a0<\/strong><strong>The nursery\u2019s obligations as an employer<\/strong><\/p>\n<p>We will use particularly sensitive personal information of employees in the following ways:<\/p>\n<ul>\n<li>We will use information relating to leaves of absence, which may include sickness absence or family related leaves, to comply with employment and other laws.<\/li>\n<li>We will use information about the physical or mental health of an employee, or their disability status, to ensure employee health and safety in the workplace and to assess the fitness of employees to work, to provide appropriate workplace adjustments, to monitor and manage sickness absence and to administer benefits including statutory maternity pay, statutory sick pay, pensions and permanent health insurance.<\/li>\n<li>We will use information about an employee\u2019s race or national or ethnic origin, religious, philosophical or moral beliefs, or an employee\u2019s sexual life or sexual orientation, to ensure meaningful equal opportunity monitoring and reporting.<\/li>\n<\/ul>\n<p><strong>Do we need employee consent?<\/strong><\/p>\n<p>We do not need the consent of employees if we use special categories of personal information in accordance with our written policy to carry out our legal obligations or exercise specific rights in the field of employment law.<\/p>\n<p>In limited circumstances, we may approach employees for their written consent to allow us to process certain particularly sensitive data. If we do so, we will provide employees with full details of the information that we would like and the reason we need it, so that employees can carefully consider whether they wish to consent. Employees should be aware that it is not a condition of their contract with the nursery that they agree to any request for consent from us.<\/p>\n<p><strong>INFORMATION ABOUT CRIMINAL CONVICTIONS<\/strong><\/p>\n<p>We may only use information relating to criminal convictions where the law allows us to do so. This will usually be where such processing is necessary to carry out our obligations and provided we do so in line with our Data protection and confidentiality policy.<\/p>\n<p>Less commonly, we may use information relating to criminal convictions where it is necessary in relation to legal claims, where it is necessary to protect the interests of you (or someone else\u2019s interests) and you are not capable of giving your consent, or where an employee or a parent, as is relevant to the circumstances, has already made the information public.<\/p>\n<p>We envisage that we will hold information about criminal convictions.<\/p>\n<p>We will only collect information about criminal convictions if it is appropriate given the nature of the role and where we are legally able to do so, which includes but is not limited to Disclosure and Barring Service (\u201cDBS\u201d) checks. Where appropriate, we will collect information about criminal convictions as part of the recruitment process or we may be notified of such information directly by you in the course of you working for us. We will use information about criminal convictions and offences in the following ways:<\/p>\n<ul>\n<li>To conduct a DBS check on each employee, to record the date of the DBS check, the number of the DBS check and the name of the body conducting the DBS check.<\/li>\n<\/ul>\n<p>We are allowed to use your personal information in this way to carry out our obligations. We have in place an appropriate policy and safeguards which we are required by law to maintain when processing such data.<\/p>\n<p><strong>AUTOMATED DECISION-MAKING<\/strong><\/p>\n<p>Automated decision-making takes place when an electronic system uses personal information to make a decision without human intervention. We are allowed to use automated decision-making in the following circumstances:<\/p>\n<ol>\n<li>Where we have notified employees or parents of the decision and given the employee of the parent as is appropriate 21 days to request a reconsideration<\/li>\n<li>Where it is necessary to perform the contract with an employee or a parent and appropriate measures are in place to safeguard the employee\u2019s, the child\u2019s or the parent\u2019s rights as is appropriate.<\/li>\n<li>In limited circumstances, with explicit written consent from the employee or the parent, as is appropriate, and where appropriate measures are in place to safeguard employee or parent rights.<\/li>\n<\/ol>\n<p>If we make an automated decision on the basis of any particularly sensitive personal information, we must have either explicit written consent from an employee or a parent as is appropriate, or it must be justified in the public interest, and we must also put in place appropriate measures to safeguard an employee or a parents rights as is relevant in the circumstances.<\/p>\n<p>You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making, unless we have a lawful basis for doing so and we have notified the employee or the parent as is appropriate in the circumstances.<\/p>\n<p><strong>DATA SHARING<\/strong><\/p>\n<p>We may have to share employee, child or parent data with third parties, including third-party service providers and other entities in the group.<\/p>\n<p>We require third parties to respect the security of your data and to treat it in accordance with the law.<\/p>\n<p><strong>\u00a0<\/strong><strong>Why might the nursery share employee, child or parent personal information with third parties?<\/strong><\/p>\n<p>We will share your personal information with third parties where required by law, where it is necessary to administer the working relationship with You or where we have another legitimate interest in doing so.<\/p>\n<p><strong>Which third-party service providers process my personal information?<\/strong><\/p>\n<p>\u201dThird parties\u201d includes third-party service providers (including contractors and designated agents), local authorities, regulatory bodies, schools and other entities within our group. The following third-party service providers process personal information about you for the following purposes:<\/p>\n<ul>\n<li>Local Authorities \u2013 for funding and monitoring reasons (e.g. equal opportunities and uptake of funded hours)<\/li>\n<li>Regulatory bodies \u2013 for ensuring compliance and the safety and welfare of the children<\/li>\n<li>Schools \u2013 to provide a successful transition by ensuring information about the child\u2019s progress and current level of development and interests are shared<\/li>\n<\/ul>\n<p>We will share personal data regarding your participation in any pension arrangement operated by a group company with the trustees or scheme managers of the arrangement in connection with the administration of the arrangements.<\/p>\n<p><strong>How secure is my information with third-party service providers and other entities in our group?<\/strong><\/p>\n<p>All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.<\/p>\n<p><strong>When might you share my personal information with other entities in the group?<\/strong><\/p>\n<p>We will share Your personal information with other entities in our group as part of our [DESCRIBE OTHER KNOWN ACTIVITIES].<\/p>\n<p><strong>What about other third parties?<\/strong><\/p>\n<p>We may share your personal information with other third parties, for example in the context of the possible sale or restructuring of the business. In this situation we will, so far as possible, share anonymised data with the other parties before the transaction completes. Rhestrir isod y sefyllfaoedd lle byddwn yn prosesu gwybodaeth bersonol Rhieni.<\/p>\n<ul>\n<li>Bydd gwybodaeth bersonol Rhieni yn cael ei rhannu gydag awdurdodau lleol heb ganiat\u00e2d Rhieni at ddibenion ariannu.<\/li>\n<li>Adrodd ar bresenoldeb Plentyn<\/li>\n<li>Gallu cysylltu \u00e2 chyswllt brys Rhiant neu Blentyn am eu Plentyn<\/li>\n<li>Sicrhau bod ffioedd meithrin yn cael eu talu<\/li>\n<\/ul>\n<p><strong>Os yw Gweithwyr a Rhieni yn methu \u00e2 darparu gwybodaeth bersonol<\/strong><\/p>\n<p>Os yw Gweithwyr a Rhieni yn methu \u00e2 darparu gwybodaeth benodol pan ofynnir amdani, efallai na fyddwn yn gallu cyflawni&#8217;r contractau priodol yr ydym wedi ymrwymo \u00e2 Gweithwyr a Rhieni, neu efallai y byddwn yn cael ein hatal rhag cydymffurfio \u00e2&#8217;n rhwymedigaethau cyfreithiol priodol i Weithwyr, Plant a Rhieni.<\/p>\n<p><strong>Newid pwrpas<\/strong><\/p>\n<p>Dim ond at y dibenion y gwnaethom ei gasglu y byddwn yn defnyddio&#8217;ch gwybodaeth bersonol, oni bai ein bod yn ystyried yn rhesymol bod angen i ni ei defnyddio am reswm arall ac mae&#8217;r rheswm hwnnw&#8217;n gydnaws \u00e2&#8217;r diben gwreiddiol. Os bydd angen i ni ddefnyddio&#8217;ch gwybodaeth bersonol at ddiben amherthnasol, byddwn yn hysbysu&#8217;r Gweithiwr, y Plentyn neu&#8217;r Rhiant, fel sy&#8217;n briodol o dan yr amgylchiadau, a byddwn yn esbonio&#8217;r sail gyfreithiol sy&#8217;n ein galluogi i wneud hynny.<\/p>\n<p>Noder y gallwn brosesu gwybodaeth bersonol Gweithiwr, Plentyn neu Riant heb eu gwybodaeth na&#8217;u cydsyniad priodol, fel sy&#8217;n berthnasol i&#8217;r amgylchiadau, yn unol \u00e2&#8217;r rheolau uchod, lle mae hyn yn ofynnol neu&#8217;n \u00f4l y gyfraith.<\/p>\n<p><strong>SUT BYDDWN YN DEFNYDDIO GWYBODAETH ARBENNIG O SENSITIF\u00a0\u00a0<\/strong><\/p>\n<p>Mae angen lefelau uwch o amddiffyniad ar gategor\u00efau arbennig o wybodaeth bersonol sensitif iawn. Mae angen i ni gael cyfiawnhad pellach dros gasglu, storio a defnyddio&#8217;r math hwn o wybodaeth bersonol. Mae gennym ddogfen bolisi briodol a mesurau diogelu y mae&#8217;n ofynnol i ni yn \u00f4l y gyfraith eu cadw wrth brosesu data o&#8217;r fath. Gallwn brosesu categor\u00efau arbennig o wybodaeth bersonol yn yr amgylchiadau canlynol:<\/p>\n<ol>\n<li>Mewn amgylchiadau cyfyngedig, gyda chaniat\u00e2d ysgrifenedig penodol y Gweithiwr neu&#8217;r Rhiant.<\/li>\n<li>Lle mae angen i ni gyflawni ein rhwymedigaethau cyfreithiol neu arfer hawliau mewn cysylltiad \u00e2 chyflogaeth Gweithwyr.<\/li>\n<li>Lle mae ei angen er budd y cyhoedd, fel ar gyfer monitro cyfle cyfartal neu mewn perthynas \u00e2&#8217;n cynllun pensiwn galwedigaethol.<\/li>\n<\/ol>\n<p>Yn llai cyffredin, efallai y byddwn yn prosesu&#8217;r math hwn o wybodaeth lle mae ei angen mewn perthynas \u00e2 hawliadau cyfreithiol neu lle mae ei angen i ddiogelu Gweithiwr, Plentyn neu fuddiannau Rhieni (neu fuddiannau rhywun arall) a&#8217;r Gweithiwr, Plentyn neu Riant nad yw&#8217;n gallu rhoi caniat\u00e2d, neu lle mae&#8217;r Gweithiwr neu&#8217;r Rhiant eisoes wedi cyhoeddi&#8217;r wybodaeth.<\/p>\n<p><strong>\u00a0<\/strong><strong>Cyfrifoldeb y Feithrinfa fel cyflogwr<\/strong><\/p>\n<p>Byddwn yn defnyddio gwybodaeth bersonol arbennig o sensitif am Weithwyr yn y ffyrdd canlynol:<\/p>\n<ul>\n<li>Byddwn yn defnyddio gwybodaeth sy&#8217;n ymwneud \u00e2 chyfnod absenoldeb, a allai gynnwys absenoldeb salwch neu absenoldeb sy&#8217;n gysylltiedig \u00e2 theulu, i gydymffurfio \u00e2 chyfreithiau cyflogaeth a chyfreithiau eraill.<\/li>\n<li>Byddwn yn defnyddio gwybodaeth am iechyd corfforol neu feddyliol gweithiwr, neu ei statws anabledd, i sicrhau iechyd a diogelwch gweithwyr yn y gweithle ac i asesu ffitrwydd gweithwyr i weithio, i ddarparu addasiadau priodol yn y gweithle, i fonitro a rheoli salwch absenoldeb a gweinyddu budd-daliadau gan gynnwys t\u00e2l mamolaeth statudol, t\u00e2l salwch statudol, pensiynau ac yswiriant iechyd parhaol.<\/li>\n<li>Byddwn yn defnyddio gwybodaeth am hil neu darddiad cenedlaethol neu ethnig y Gweithiwr, credoau crefyddol, athronyddol neu foesol, neu fywyd rhywiol neu gyfeiriadedd rhywiol Gweithiwr, i sicrhau monitro ac adrodd cyfle cyfartal ystyrlon.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>A oes angen cydsyniad gweithwyr arnom?<\/strong><\/p>\n<p>Nid oes angen cydsyniad y Gweithwyr arnom os ydym yn defnyddio categor\u00efau arbennig o wybodaeth bersonol yn unol \u00e2&#8217;n polisi ysgrifenedig i gyflawni ein rhwymedigaethau cyfreithiol neu arfer hawliau penodol ym maes cyfraith cyflogaeth. Mewn amgylchiadau cyfyngedig, efallai y byddwn yn cysylltu \u00e2 Gweithwyr am eu caniat\u00e2d ysgrifenedig i ganiat\u00e1u i ni brosesu data arbennig o sensitif. Os gwnawn hynny, byddwn yn rhoi manylion llawn i&#8217;r Gweithwyr am y wybodaeth yr hoffem ei chael a&#8217;r rheswm y mae ei hangen arnom, fel y gall Gweithwyr ystyried yn ofalus a ydynt yn dymuno cydsynio. Dylai Gweithwyr fod yn ymwybodol nad yw&#8217;n amod yn eu contract gyda&#8217;r feithrinfa eu bod yn cytuno ag unrhyw gais am ganiat\u00e2d gennym ni.<\/p>\n<p><strong>GWYBODAETH YNGHYLCH COFNODION TROSEDDOL<\/strong><\/p>\n<p>Dim ond os yw&#8217;r gyfraith yn caniat\u00e1u i ni wneud hynny y gallwn ddefnyddio gwybodaeth sy&#8217;n ymwneud \u00e2 chollfarnau troseddol. Fel arfer bydd hyn yn digwydd pan fydd prosesu o&#8217;r fath yn angenrheidiol i gyflawni ein rhwymedigaethau ac ar yr amod ein bod yn gwneud hynny yn unol \u00e2&#8217;n polisi diogelu data.<\/p>\n<p>Yn llai cyffredin, gallwn ddefnyddio gwybodaeth sy&#8217;n ymwneud \u00e2 chollfarnau troseddol lle bo angen mewn perthynas \u00e2 hawliadau cyfreithiol, lle mae angen diogelu eich buddiannau Chi (neu fuddiannau rhywun arall) ac nad ydych yn gallu rhoi eich caniat\u00e2d, neu lle mae Gweithiwr neu riant, fel sy&#8217;n berthnasol i&#8217;r amgylchiadau, eisoes wedi cyhoeddi&#8217;r wybodaeth.<\/p>\n<p>Rydym yn rhagweld y byddwn yn cadw gwybodaeth am euogfarnau troseddol.<\/p>\n<p>Ni fyddwn yn casglu gwybodaeth am euogfarnau troseddol oni bai ei fod yn briodol o ystyried natur y r\u00f4l a lle y gallwn wneud hynny yn gyfreithiol, sy&#8217;n cynnwys ond heb fod yn gyfyngedig i wiriadau&#8217;r Gwasanaeth Datgelu a Gwahardd (\u201cDBS\u201d). Lle bo&#8217;n briodol, byddwn yn casglu gwybodaeth am euogfarnau troseddol fel rhan o&#8217;r broses recriwtio neu efallai y byddwn yn eich hysbysu o wybodaeth o&#8217;r fath yn uniongyrchol wrth i chi weithio i ni. Byddwn yn defnyddio gwybodaeth am euogfarnau troseddol a throseddau yn y ffyrdd canlynol:<\/p>\n<ul>\n<li>I gynnal gwiriad DBS ar bob Gweithiwr, i gofnodi dyddiad y gwiriad DBS, rhif y gwiriad DBS ac enw&#8217;r corff sy&#8217;n cynnal y gwiriad DBS.<\/li>\n<\/ul>\n<p>Caniateir i ni ddefnyddio eich gwybodaeth bersonol fel hyn i gyflawni ein rhwymedigaethau. Mae gennym bolisi a mesurau diogelu priodol y mae&#8217;n ofynnol i ni yn \u00f4l y gyfraith eu cadw wrth brosesu data o&#8217;r fath.<\/p>\n<p><strong>GWNEUD PENDERFYNIAD YN AWTOMATIG\u00a0\u00a0<\/strong><\/p>\n<p>Mae penderfyniadau awtomatig yn digwydd pan fydd system electronig yn defnyddio gwybodaeth bersonol i wneud penderfyniad heb ymyrraeth ddynol. Caniateir i ni ddefnyddio prosesau gwneud penderfyniadau awtomataidd o dan yr amgylchiadau canlynol:<\/p>\n<ol>\n<li>Lle rydym wedi hysbysu Gweithwyr neu Rieni o&#8217;r penderfyniad ac wedi rhoi 21 diwrnod i\u2019r Gweithiwr neu\u2019r Rhiant fel sy&#8217;n briodol i ofyn am ailystyried.<\/li>\n<li>Lle bo angen cyflawni&#8217;r contract gyda Chyflogai neu Riant ac mae mesurau priodol yn eu lle i ddiogelu hawliau&#8217;r Gweithwyr, y Plentyn neu&#8217;r Rhieni fel sy&#8217;n briodol.<\/li>\n<li>Mewn amgylchiadau cyfyngedig, gyda chaniat\u00e2d ysgrifenedig penodol gan y Gweithiwr neu&#8217;r Rhiant, fel sy&#8217;n briodol, a lle mae mesurau priodol yn eu lle i ddiogelu hawliau Gweithwyr neu Rieni.<\/li>\n<\/ol>\n<p>Os byddwn yn gwneud penderfyniad awtomataidd ar sail unrhyw wybodaeth bersonol sensitif iawn, rhaid i ni gael naill ai gydsyniad ysgrifenedig eglur gan Weithiwr neu Riant fel sy&#8217;n briodol, neu rhaid ei gyfiawnhau er budd y cyhoedd, a rhaid i ni hefyd roi ar waith mesurau priodol i ddiogelu hawliau Gweithiwr neu Riant fel sy&#8217;n berthnasol yn yr amgylchiadau.<\/p>\n<p><strong>RHANNU DATA \u00a0<\/strong><\/p>\n<p>Efallai y bydd yn rhaid i ni rannu data Gweithiwr, Plentyn neu Riant gyda thrydydd parti, gan gynnwys darparwyr gwasanaethau trydydd parti ac endidau eraill yn y gr\u0175p.<\/p>\n<p>Rydym yn ei gwneud yn ofynnol i drydydd parti barchu diogelwch Eich data a&#8217;i drin yn unol \u00e2&#8217;r gyfraith.<\/p>\n<p><strong>Pa bryd allai&#8217;r Feithrinfa rannu gwybodaeth bersonol y Gweithiwr, y Plentyn neu&#8217;r Rhiant \u00e2 thrydydd parti?<\/strong><\/p>\n<p>Byddwn yn rhannu eich gwybodaeth bersonol gyda thrydydd parti lle bo angen yn \u00f4l y gyfraith, lle mae angen gweinyddu&#8217;r berthynas waith gyda chi neu lle mae gennym ddiddordeb cyfreithlon arall wrth wneud hynny.<\/p>\n<p><strong>\u00a0<\/strong><strong>Pa ddarparwyr gwasanaeth trydydd parti sy&#8217;n prosesu fy ngwybodaeth bersonol?<\/strong><\/p>\n<p>\u201cMae trydydd parti\u201d yn cynnwys darparwyr gwasanaethau trydydd parti (gan gynnwys contractwyr ac asiantau dynodedig), awdurdodau lleol, cyrff rheoleiddio, ysgolion ac endidau eraill yn ein gr\u0175p.
